SHIPPING INFORMATION

Shipping prices are calculated automatically at the time of online checkout and are confirmed by you, our customer, before orders are processed. We charge a processing fee per origin (restaurant or pub location), and then each item’s shipping charge is based on weight. Items may arrive in individual shipments from each restaurant/location, and any gift messages will be included in each separate package. All items are shipped via the United States Postal Service with a delivery confirmation number, and typically arrive within 5 business days. Please allow up to 10 business days to receive all of your merchandise.

RETURN/EXCHANGE POLICY

We hope you are satisfied with your HungryPotato.com order. If you are dissatisfied with your purchase we offer exchanges only, from the same merchant/establishment only, if you contact us within 10 days of receipt of the item. We will not accept exchanges returned more than 15 days after delivery, or any item that has obvious signs of use. Refunds are available only if you receive a damaged, defective, or incorrect item and a replacement item is not available. DO NOT CALL THE ESTABLISHMENT DIRECTLY REGARDING YOUR MERCHANDISE. CALL HUNGRYPOTATO.COM FOR ALL CUSTOMER SERVICE ISSUES. RETURNS AND/OR EXCHANGES WILL NOT BE ACCEPTED WITHOUT AN EXCHANGE AUTHORIZATION NUMBER which can only be issued by contacting HungryPotato.com.

Please follow the procedures listed below:

1. Call HungryPotato.com at 1-877-8-POTATO, or email us at customerservice@hungrypotato.com, for a Exchange Authorization Number and Shipping Address.
2. Repackage the merchandise in appropriate shipping materials, along with a copy of the Order Summary and the Exchange Authorization Number given to you by HungryPotato.com.
3. Ship the package via a method that is trackable (such as UPS or USPS with Delivery Confirmation) ONLY.

NOTE: Shipping fees are not refundable.

PRIVACY POLICY

HungryPotato.com uses a secure gateway to ensure secure transactions. All credit card information is encrypted during transmission and then stored on a secure server. Your credit card information is never reused except to issue refunds or make other required adjustments.
HungryPotato.com will never sell, loan, rent, trade or give away your name, email, address or any other personal information to any third party without your permission. HungryPotato.com may use your email address occasionally to communicate with you about your current orders or our special promotions.

SALES TAX

All California residents will be charged sales tax on any taxable items ordered.

MERCHANDISE PRICES AND AVAILABILITY

All merchandise listed on our website is subject to availability. We are not responsible for any items which are not available at the time of your order. All prices subject to change prior to purchase.

TERMS AND CONDITIONS

Definitions:

In this Agreement:

"Company" shall mean, HungryPotato.com, LLC, and www.hungrypotato.com, a California corporation.

"Customer" shall mean anyone who orders from this site, submits a credit card number on this site for themselves or others, authorizes an order to be placed on their behalf, or otherwise uses this site. Customer means you.

While this is the specific legalese for our agreement, all of the promises, representations, limitations and conditions listed or described throughout the site are part of any agreement between Customer and Company.

Venue:

This Agreement shall be governed by, and construed in accordance with, the laws of the State of California. Company and Customer agree that should litigation occur, venue shall be solely in Los Angeles County, State of California.

Arbitration and Litigation:

Any disputes under this Agreement shall be determined by binding arbitration. If the parties cannot agree on an arbiter, each party shall choose one arbiter, those two arbiters shall mutually choose a third arbiter. The dispute will be resolved by that three-arbiter panel using the rules agreed upon by that three-arbiter panel. The prevailing party in any such arbitration shall be entitled to receive from the other party the costs of such arbitration, including reasonable attorney fees. In the event it is necessary to enforce the terms of this contract or that arbitration, in a court of law or equity the prevailing party shall be entitled to reimbursement of its reasonable costs and fees, including attorney's fees, even if no case is filed, or at trial, and on appeal.

Severability:

If any provision of this Agreement shall be found invalid, illegal or unenforceable, in whole or in part, neither the validity of the remaining part of such provisions nor the validity of any other provision shall be in any way affected and shall be given full force and effect.

Liability & Warranties:

Company's liability is limited to the retail price of the item purchased. Company is not liable for consequential or incidental damages, even if Company has been informed of the circumstances. Company does not make any warranties of merchantability, or fitness for a particular purpose, express or implied.

Company reserves the right to limit quantities, or to refuse to sell items if those items have been listed with incorrect price, description, or material information.

Waiver:

Any failure by any party to enforce any provision hereof shall not in any way affect the subsequent right of such party to enforce such provision or any other provision.

Permissions Customer Grants Company:

Under these terms and conditions Customer gives Company permission to charge Customer's credit card for merchandise shipped or services performed consistent with Customer's order, share Customer's information as necessary to process Customer's order, contact Customer about Customer's order and contact Customer to follow up with Customer after Customer's order.
